GENERAL SELLING CONDITIONS
1. Minimum Order Policy
We have a minimum order of £600/€686 (per order, ex. VAT and duty) or a full unmixed pallet of minimum 576 bottles.
The minimum order does not apply to wines of Morando, Verga, Sant'Orsola, Canti, Cortigiano.
In these cases the minimum order is a complete load with about 12500 bottles (according to the producers) and with a maximum of two different labels per load.
2. Private Sales
Getapple does not sell its wines to individuals. Only to distributors, wholesalers, HoReCa, importers.
3. Trade Sales
All wines are sold EXW the respective manufacturing companies unless otherwise specified. Subsequent delivery costs (and VAT if due) will be charged, as appropriate, at the time of shipment. Customers who want to export products from our catalog outside Europe must contact a suitable shipper.
4.1 Unless an account is established, payment will be due upon invoice submission. Invoices are payable 7 days from the date of issue and in any case before loading the goods on the courier's truck, unless otherwise agreed.
4.2 In case of non-payment of the amount due within the specified terms, we reserve the right to charge a cancellation fee of up to 10% of the outstanding amount or the actual losses incurred by GETAPPLE following cancellation if more than 10%. GETAPPLE reserves the right to use any amount held in account or otherwise received by or on behalf of the customer for the termination of such cancellation charges.
4.3 GETAPPLE has the right to charge interest on unpaid invoices with a minimum rate of 4% above the base rate of the Bank of England from the date of payment.
4.4 GETAPPLE shall be entitled to sell any wines which it is holding or storing on behalf of a customer to discharge outstanding invoices (whether on account of cancellation fees, interest or otherwise). GETAPPLE will account to the customer for any cash balance held after discharging all outstanding invoices.
The title of all wines will remain with GETAPPLE or their respective suppliers until all sums owed by the buyer are fully paid.
All wines not collected within one month from the date of collection. will be stored in our customer reserves or in those of their respective suppliers at a cost of £ 16.63 excluding VAT for each non-withdrawn product pallet and for a period of 30 days (or part of it). In the event of a full load not collected at the scheduled date, costs will be charged for 24 full pallets.
7. Quality Control
GETAPPLE adheres strictly to a condition code regarding all wines. All suppliers have been informed in writing that capsules and labels should be in good condition, and that ullage descriptions should conform to base neck or better. In the case of most older wines, the colour should be deemed acceptable. In the event that wines are corked or out of condition for consumption, it will be at the discretion of GETAPPLE that replacements be made available, without obligation. We are fastidious with regard to provenance and storage conditions, so problems of this nature rarely occur. We do not purchase US strip-labelled stock or stock that has been shipped back into Europe from the Americas or Asia unless otherwise specified or specifically requested.
8. Force Majeure
The company will not be liable for failure to meet agreed obligations due to prevailing circumstances beyond our reasonable control.
All contracts are subject to English law and jurisdiction. All wines are offered subject to market movement and remaining unsold.
10. Duty and VAT
The wines are offered for sale ex-works of the manufacturer, others may be available at our warehouse. Wine requests from buyers in the United Kingdom are subject to duties and VAT at the prevailing tariffs. Wines sold with export obligation must be exported outside the European Community within 30 days from the invoice if collected by the client's shipper or 90 days from the invoice if sent by GETAPPLE, otherwise the UK VAT will be charged to the customer.
Prices on this Collection Wine List are in Euro per bottle (6x75cl) as indicated, and are offered EXW unless otherwise specified. Selling prices do not include VAT, any tax and delivery charges.

In the event of a full load not collected at the scheduled date, costs will be charged for 32 full pallets.
Any order sent to us is accepted as formal. This will be presented in a separate, formal invoice.
We will not be liable for any failure to perform our duties under or in connection with this agreement for any reasons which are beyond our reasonable control. This may include any failure on the part of our designated warehouse operator or facility which is outside of our control, as well as strikes, lockouts or other industrial action; civil commotion, riot, invasion, war, threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural physical disaster.
15.1 We reserve the right to alter these terms and conditions at any time. Any such changes will take effect when posted on our website. It is your responsibility to read the terms and conditions on each occasion the products ordered. Your knowledge of our website shall signify your acceptance to be bound by these latest terms and conditions.
15.2 If any provision of these terms and conditions is held by a court or other competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these terms and conditions and the remainder of the provision in question shall not be affected.
15.3 We will not be liable for any failure to meet our obligations occasioned by circumstances beyond our reasonable control.
15.4 These terms and conditions shall be governed by the laws of England and Wales and you agree that the courts of England and Wales shall have exclusive jurisdiction in relation to.
